Shazzle users may register community names (or “Tags”) for personal use for free, subject to losing the rights to use the name (at Shazzle’s sole option) if they do not use their given legal name, or if they portray someone on their Shazzle site other than themselves.

Users may register a community name for commercial use for the first 12 months for free, subject to annual update charges as posted and amended by Shazzle from time to time. No registrant of a community name may sell, donate or otherwise transfer the rights to use that name to a third party. All rights to the name revert back to Shazzle once the original registrant ceases to own and operate the community so named. All use of community names, both free and purchased, are subject to the following restrictions.

1. Registrant must establish and maintain active use of the community. ‘Parking’ of names is not allowed and will render the name subject to forfeiture back to Shazzle. Determination of use will be judged by standards promulgated and updated by Shazzle from time to time and may include quality of content in the community, ability to interact with the community, and user rating of the community.

The use of any Shazzle community name containing exact text of any name (or any confusingly similar variation) listed on World Wide Web between the ‘www.’ and ‘.com’ (or ‘.net’ etc.) at the time of the Shazzle registration will be subject to forfeiture (at Shazzle’s sole option) to the registrant and trademark holder of said www domain name upon their request and ability to certify said registration and trademark. Upon such request and certification Shazzle may require (at Shazzle’s sole option) the Shazzle registrant to forfeit the community name without compensation. For example, if an entity other than the owner of the ‘Budweiser’ name registers this as a Shazzle community name, their ownership and use of said name is subject (at Shazzle’s sole option) to forfeiture without compensation.

In the event that (in Shazzle’s sole opinion) two users appear to have legitimate trademark rights in the same community name, Shazzle at its sole option may require the use of the disputed name be resolved by the users themselves and not by Shazzle.

3. Registrants should be aware of trademark, copyright, and other laws that may restrict the use of certain names and phrases. Registrant shall bear all liability for improper use of any protected name or phrase on the Shazzle system.
